Section I – The organizer of the competition. General conditions

1.1. The organizer of the competition entitled «Surprise di Moyond Nicolae» (hereinafter called «Competition») is the owner of the Pepanza.ro Facebook page, with the URL:

1.2. This competition is organized and will be held according to the instructions of the organizer, in the conditions of this regulation (hereinafter called «Regulation») and Instagram Pepanza.ro – that the participants are obliged to respect.

In order to bring to the attention of those concerned, the regulation is available, free of charge, to any person interested, by accessing the sites mentioned above. The organizer reserves the right to modify and/or complete the regulation at any time, implicitly any of the conditions relating to the organization and conduct of the competition, as well as the right to suspend and/or order the resolution of its development, with the previous notification of the public regarding any modification of the regulation provisions. The changes and/or completions will be communicated with at least 24 (twenty -four) hours before they are applicable, viewing on Facebook sites and pages. In the case of subsequent ones/or completions regarding the conditions or mechanism of the competition, the organizer can order the publication of updated variants of the regulation on the site.

Section II-NIGHTA and a place of competition

2.1. The competition will be launched starting from 6 December 2021 and will end on December 7, 2021 – 12:00:00 (Hour of Romania).

2.2. The competition will take place online, on the Pepanza.ro Facebook page, and the winners will be designated by drawing lots and will be announced on the aforementioned page.

Section II-The right to participate. Conditions of participation. Signature conditions

3.1. The competition is open to the participation of all natural people (hereinafter called «participants»), which, on the date of registration, cumulatively satisfy the following conditions:

3.1.1. have the age of 18 (eighteen) years;

3.1.2 Have a valid Facebook account.

3.2. The legal entities (regardless of the form of organization), family businesses or any other associative form, employees of the organizer, as well as family members and their relatives live and/or collateral (up to the 4th degree), as children, parents, husband/wife, brothers, sisters, cannot be recorded in the competition. In order to avoid any confusion and/or misunderstanding, the organizer indicates any natural person in the work with the organizer, according to the applicable work legislation.

3.3. The valid registration for participation in the competition necessarily implies the cumulative fulfillment of the following conditions:

3.3.1. Keeping the right to participate. Therefore, participants must be in the category of people with the right to participate, according to the conditions established in point 3.1. Above.

3.4. Registration can be made from the launch date of the competition and at any time during the course. Any person with the right to participate, according to the conditions of this regulation, can be recorded in the competition, at any time, by publishing a comment on the Facebook page to the post dedicated to the competition and following the organizer’s Facebook page.

Section IV-the mechanism of competition. Prizes. The designation of the winners

4.1. Without prejudice to the cumulative fulfillment of the conditions relating to the registration of the articles in the competition, but also to the other rules relating to the organization and conduct of the competition, the winner will be appointed at the end of the competition period. The organizer has the obligation to make public the name of the winner and the prize granted, viewing on Facebook.

4.2. The winner will be designated by drawing lots, using Random.org, at the end of the competition, if he satisfied all the conditions specified in the text of the competition.

4.3. The winner will be announced on the Facebook page, following which within a maximum of 24 hours, the organizer will contact through a private message on the organizer’s Facebook page for claiming the prize.

4.4 Prizes:

• Personalized canvas painting 60 x 90 cm
• Tablou canvas stoc 50 x 70 cm
• Multicanva painting stock 1* 20 x 60 cm + 2* 20 x 30 cm + 2* 20 x 40 cm

4.5. None of the prizes offered in this competition can be replaced with its cash and/or other good value or service.

4.6. The effective assignment of the prizes, respectively of possession, will be reached through the courier, after the winner has been validated. If the winner does not contact the organizer within a maximum of 24 hours after the extraction, the award will automatically return to the organizer and a new extraction will be performed.

AV Section – Personal Data Protection

5.1. By registering and participating in the competition, the participants completely accept the provisions of this regulation and agree that the personal data provided to enter the organizer’s database and to be used in the conditions of the law in relation to the following purposes: (i) validation of the winners; (ii) publish the list of winners; (iii) award the prizes of the competition; (IV) Communications and information.

5.2. The organizer undertakes to conform to the provisions of law no. 677/2001 as regards the protection of personal data collected on the occasion and within the competition, for the duration and after its resolution. Therefore, the organizer undertakes to maintain the confidentiality of the personal data of the participants recorded in the competition and to use them in accordance with the relevant legislation.

5.3. Participants registered in the competition are guaranteed the rights provided by law 677/2001, in particular those relating to:

1. A) the right of access to data, according to which any data subject has the right to obtain from the organizer, on request and free of charge for a request per year, the confirmation that the data concerning them is processed by the organizer;

b) the right of opposition, according to which the subject of the data has the right to oppose at any time, for well -founded and legitimate reasons relating to its particular situation, that the data aimed at it are subject to a processing, unless there are contrary legal provisions;

c) the right to intervene on the data, according to which any subject of data has the right to obtain from the organizer, on request and free of charge: a) depending on the case, the correction, updating, blocking or cancellation of the data whose processing does not comply with the law, in particular of incomplete or inaccurate data; b) depending on the case, the transformation into anonymous data of the data whose processing does not comply with the law; c) perform the notification to third parties to whom the data were disclosed, of any operation performed according to the letter. a) EB) above, if this notification does not prove impossible or does not imply an disproportionate effort towards the legitimate interest that could be damaged.

5.4. At the express request of any of the participants, the organizer will guarantee the exercise of any of the rights provided in point 6.4 above. In order to exercise these rights, the participants recorded in the competition will send the organizer, in his registered office, a request prepared in writing, signed and dated. The organizer will respond to this request within 30 calendar days from the date of registration.

Section VI-interruption/cessation of the competition

6.1. The competition can be suspended or, depending on the case, can end at any time in the case of an event that represents a greater force or a fortuitous case, in acceptance defined by law, even if the organizer, regardless of his will, is not able to guarantee the best conditions of the competition or the purpose for which the competition is not organized.

6.2. Competition can also cease or may be suspended or, depending on the case, reprogrammed at any time according to the organizer’s decision, provided that first this situation, according to the relevant provisions of this regulation.

Section VII-Limitations on the organizer’s liability

7.1. The organizer is not responsible and there is no obligation and/or responsibility in relation to potential problems (including technical nature) have intervened in the sending/receipt of a/winner messages on the site.

7.2. Furthermore, the organizer does not assume any obligation and/or responsibility, of any kind and will not be held responsible as regards the exclusion from the competition and/or by the refusal to register any participant to the competition, if there is any of the terms and conditions of this regulation.

7.3. If, even after the validation of a winner (whether it was in possession of the prize), the failure to comply with any of the provisions of the regulation and/or an organization of the organizer will be noted, reserves the right to refuse the registration of a participant, to exclude the participant, to cancel the winner, return of the prize assigned within a maximum of 30). The discovery of one of these situations will be recorded by a written decision, issued by the organizer and which will be considered an additional act to the regulation.

Section VIII provisions-finals

8.1. The conditions for the organization and conduct of the competition and the instructions of the organizer are mandatory and applicable to all participants. 8.2. The organizer will have the right to undertake all the necessary measures to avoid or remove the attempts of fraud or the fraud and/or abuses as regards registration and participation in the competition and which could influence in any way, directly or indirectly, without the list being limiting, the good conduct of the competition, the image of the organizer, the site or the organization of the individual,

8.3. Any misunderstandings, differences, conflicts or quarrelsome situations between the participants and the organizer, regarding any aspect relating to the competition, will be resolved with friendly priority. If this is not reasonably possible, the jurisdiction of the competent courts of the organizer’s headquarters will be appealed.

8.4 This competition is in no way organized, sponsored, started or administered by Facebook.
